Terms & Conditions of Sale

1.1 These terms are applicable to agreements concluded between customers (“you”) and the sole proprietorship SHYFT (registered in the Dutch chamber of commerce under company number 83468285) (‘SHYFT’) via the website shyftmicrodosing.com (“website”).
1.2 Please read these terms carefully before you submit an order via the Website. These terms tell you, among others, how you may end the agreement and what to do if there is a problem.
1.3 Deviations from these terms can only be made in writing. Any order placed by you that includes terms that deviate from these terms should be interpreted as a new offer by you which may, or may not, be accepted by SHYFT.
1.4 These terms may be changed from time to time.
How to get in contact
2.1 The contact details of SHYFT can be found on the Website and, if an agreement is already concluded, in the order confirmation that has been sent to you via e-mail.
Conclusion of an agreement
3.1 Advertisements on the Website constitute a non-binding offer which can be rejected by SHYFT within 2 business days after it has been approved by you. The order confirmation that will be automatically sent to you after the conclusion of the agreement does not constitute a waiver of SHYFT’s right to revoke the offer.
3.2 If SHYFT revokes its offer, SHYFT will inform you in writing. SHYFT may only do so if the product ordered is out of stock and, due to limited time, has not been able to remove the advertiseme˙nt from the Website or the advertisement constitutes an error. Should you already have paid for the product, you will of course be refunded.
3.3 The Website is solely for the promotion of products in countries of the Economic European Union (‘EEU’), with the exception of Finland, Malta, Norway, Sweden and Switzerland. We do not ship to other regions in the world.
Products containing psilocybin and psilocin
4.1 Some products offered on the Website contain psilocybin and psilocin (i.e. truffles). We strongly advise against the use of these products in the following circumstances:
You are younger than 18 years old;
You are pregnant or breastfeeding;
You have color blindness;
You combine it with alcohol or drugs;
You are taking lithium carbonate or Tramadol;
You are in the process of tapering off from antidepressants or anti-anxiety medication (please consult your physician first in this case);
You have a serious mental or physical condition or illness (please consult your physician first in this case).
4.2 If the products containing psilocybin and psilocin are consumed as recommended (micro dosed) they will most likely not cause a psychedelic experience. However, a psychedelic experience is likely if the products are consumed in a higher dose.
4.3 expiry date of the products are indicated on the package. The products containing psilocybin and psilocin can be stored for a maximum of two months in the fridge. After the package has been opened, the products can only be kept for 4-6 days.

4.4 The content provided by SHYFT in relation to the products does not constitute medical advice. If you are seeking medical advice, diagnose or treatment, we advise you to consult a medical professional or a health provider.
Price and payment
5.1 The price of the product is indicated in the advertisement and includes VAT.
5.2 SHYFT takes all reasonable care to ensure that the price of the product shown is correct. However if SHYFT accepts and processes your order where a pricing error is obvious and unmistakable and could reasonably have been recognized by you as an error, SHYFT may rescind the agreement, refund you any sums you have paid and require the return of any products provided to you.
5.3 All payment options are set out on the check-out page of the order process. When you pay depends on the chosen payment option.
6.1 The products will be delivered to the delivery address provided by you.
6.2 If no one is available at your address to take delivery, the courier will leave you a note informing you of how to rearrange delivery.
6.3 If, after a failed delivery to you, you do not re-arrange delivery the courier will contact you for further instructions. If, despite reasonable efforts, the courier is unable to contact you or re-arrange delivery or collection, SHYFT may rescind the contract by informing you in writing. We guarantee that any payments made by you will be refunded in due course.
Right of withdrawal
7.1 With the exception of perishable goods (such as the truffles) you have a legal right of withdrawal from the agreement within 14 days without stating reasons. The withdrawal period expires 14 days after the day on which you or a third party designated by you, who is not the carrier, takes physical possession of the product. If the last day of the withdrawal period falls on a weekend or is a public holiday, the withdrawal period will be extended until the next working day.
7.2 To exercise the right of withdrawal, you must inform SHYFT via email (firstname.lastname@example.org) in which you state the product and the associated order number you wish to withdraw. You may also use the model withdrawal form (see 1) by sending it to SHYFT before the withdrawal period has expired.
7.3 Within 14 days of the withdrawal, you must return the products to SHYFT. You will find SHYFT’s address on the invoice and the Website. The costs and risks of return are for your account. The costs for insured return are approximately €6,75.
7.4 Please bear in mind that you are liable for any diminished value of the products resulting from the use of the products beyond what is necessary to establish the nature, characteristics and functioning of the products.
7.5 If you withdraw from the agreement, all payments you have made up to that point, (with the exception of any additional costs as a result of your choice for a method of delivery other than the cheapest standard delivery offered by us) will be refunded no later than 14 days after we have been informed of your decision to withdraw from the agreement. However, reimbursement will be withhold until SHYFT has received the products back or you have demonstrated that you have returned the products, whichever comes first.
7.6 SHYFT will refund you with the same payment method with which you made the original transaction, unless you have expressly agreed otherwise.
8.1 Consumers residing in European Member States are entitled to a free of charge repair and (depending on the circumstances) may be entitled to a replacement, discount or refund by the seller of goods which do not conform with the agreement.
8.2 Should the products you purchased on the Website are not in conformity with the agreement, please contact us via: email@example.com.
8.3 If you are not a consumer, SHYFT’s liability in relation the statutory warranty is limited to the purchase amount of the product.
9.1 When in these terms the words “writing” or “written” are used, this includes emails.
9.2 Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
9.3 Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are a consumer and are not happy with how SHYFT has handled your complaint, you may get in contact with the online dispute resolution platform of the European Commission at the following address: http://ec.europa.eu/Customers/odr/.
9.4 If you are a consumer, these terms are governed by the laws of the country where you reside. If you are not a consumer, these terms are governed by the laws of country where SHYFT resides. The UN Convention on Contracts for the International Sales of Goods is not applicable.
9.5 If you are a consumer, legal proceedings must be brought to the competent courts of the country where you reside. If you are not a consumer, legal proceedings must be brought to the competent courts of the country where SHYFT resides.
